Title II Firearms

Title II firearms are specially designated under the National Firearms Act (NFA).

Title II firearms, colloquially called Class 3 because a dealer with a Class 2 or Class 3 Special Occupational Tax (SOT) are the only ones allowed to deal NFA firearms. With certain restrictions, Title 2 firearms (Silencers, Short-Barrel Rifles, Short-Barrel Shotguns, Machine Guns and Destructive Devices) can be owned by citizens as long as they are not a “prohibited person” (defined here) per the ATF.

The forms required are ATF 5320.1 Application to Make and Register a Firearm (Form 1), ATF 5320.4 Application for Tax Paid Transfer and Registration of Firearm (Form 4), and/or  ATF 5320.5 Application for Tax Exempt Transfer and Registration of Firearm (Form 5).
